2. DEFINITIONS
- Company: PuppytoK9
- Services: digital educational dog training content, including courses, subscriptions, memberships, and related materials
- Content / Materials: all digital content provided via the Services
- User: any individual accessing or purchasing Services
- Subscription: recurring access model
- Platform: third-party delivery systems (e.g., Kajabi)
3. ACCEPTANCE OF TERMS
By purchasing or accessing the Services, you agree to these Terms.
Where legally required, explicit consent (including for immediate performance and withdrawal waiver) is obtained during checkout.
If you do not agree, you must not use the Services.
4. ELIGIBILITY
You must be at least 18 years old or have parental/guardian consent.
We may refuse or restrict access where objectively justified, including fraud prevention, abuse prevention, or legal compliance.
5. NATURE OF SERVICES
The Services are strictly educational and informational.
The Company does not provide:
- veterinary services
- behavioural therapy services
- in-person supervision
- guarantees of results
You acknowledge that outcomes vary significantly.
6. USER RESPONSIBILITY
You are solely responsible for:
- your dog at all times
- ensuring safe environments
- selecting appropriate training conditions
- determining suitability of any exercise
- stopping any activity that causes risk or distress
- compliance with local laws and safety obligations
- use and condition of training equipment
You acknowledge that the Company has no control over:
- your dog’s behaviour
- your environment
- your execution of training methods
7. ACCOUNT SECURITY
You are responsible for maintaining confidentiality of account credentials.
You agree not to:
- share access
- transfer accounts
- allow third-party use
We may suspend access in case of breach.
8. ACCESS TO SERVICES
Access is:
- personal
- non-transferable
- non-commercial
We may modify, update, or remove Content to maintain or improve Services.
Where changes materially affect paid content, we will act in accordance with mandatory consumer law.
9. SUBSCRIPTIONS & PAYMENT
9.1 Renewal
Subscriptions renew automatically until cancelled.
9.2 Cancellation
You may cancel at any time. Access continues until the end of the billing period.
9.3 Payment failure
Access may be suspended until payment is resolved. Outstanding amounts remain due.
10. DELIVERY
Services are delivered digitally.
We aim for continuity but do not guarantee uninterrupted availability.
11. ACCESS DURATION
Where applicable, “lifetime access” means access for the reasonable operational lifetime of the product while it is commercially supported.
If discontinued, access may cease after reasonable notice where practicable.
12. INTELLECTUAL PROPERTY
All Content is protected by copyright and remains the exclusive property of PuppytoK9.
You are granted a limited, non-exclusive, non-transferable licence for personal use only.
You may not:
- copy, reproduce, or distribute Content
- share or resell access
- publicly display Content
- use Content commercially
- systematically extract or scrape Content
- upload substantial Content into AI systems or datasets
- create competing products through reproduction of Content structure or expression
This does not restrict general knowledge or skills learned independently.
13. CONFIDENTIALITY
You agree not to disclose non-public proprietary materials, including:
- internal frameworks
- course structure and design
- private community content
This does not restrict lawful personal sharing of experiences.
14. EDUCATIONAL DISCLAIMER
All Services are educational only.
No guarantees are made regarding outcomes.
Results depend on:
- dog temperament and genetics
- environment
- consistency of application
- user interpretation
15. RISK ACKNOWLEDGEMENTÂ
You expressly acknowledge that dog training involves inherent, unavoidable, and foreseeable risks.
15.1 Physical risks
Including:
- bites, scratches, or injuries caused by dogs
- injuries caused by equipment (collars, harnesses, leashes)
- falls, strain, or accidents during training
- stress-related physical reactions in animals
15.2 Behavioural risks
Including:
- increased aggression, fear, or reactivity
- behavioural regression or deterioration
- unintended reinforcement of unwanted behaviours
- unpredictable behavioural responses
15.3 Environmental risks
Including:
- interactions with other animals or humans
- property damage
- uncontrolled external stimuli
15.4 User control assumption
You acknowledge and agree that:
- you retain full control and responsibility for your dog at all times
- you determine suitability of all training activities
- you are responsible for safe execution of all instructions
- you must immediately stop any exercise that presents risk or distress
The Company does not supervise, monitor, or intervene in training activities.
15.5 Professional advice
The Services do not replace veterinary or professional behavioural advice.
You are responsible for seeking such advice where appropriate.
15.6 Assumption of risk
You voluntarily assume all foreseeable risks associated with:
- use of the Services
- application of training methods
- handling and training of your dog
15.7 Liability limitation alignment
Nothing in this clause excludes liability for:
- intent (opzet)
- gross negligence (bewuste roekeloosheid)
- death or personal injury where exclusion is prohibited by law
Subject to this, the Company is not liable for:
- incorrect application of training methods
- misuse or deviation from instructions
- animal behaviour during or after training
- environmental incidents during training
16. DIGITAL CONTENT – RIGHT OF WITHDRAWAL
You expressly consent that:
- performance begins immediately upon purchase
- you waive your statutory right of withdrawal once access begins
This consent is collected explicitly during checkout.
If access has not begun, statutory withdrawal rights remain applicable.
17. REFUNDS
All sales are final except where required by mandatory law.
This does not affect statutory consumer rights.
Refunds may be granted voluntarily in cases such as:
- duplicate payments
- verified technical errors
18. LIABILITY
To the maximum extent permitted by law:
We are not liable for:
- indirect or consequential damages
- loss of profit or revenue
- behavioural outcomes
- misuse or misinterpretation of Content
Our total liability is limited to the amount paid for the Service.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
19. TERMINATION
We may suspend or terminate access where reasonably justified due to:
- breach of Terms
- fraud or abuse
- non-payment
Termination will be proportionate to the severity of the breach.
20. THIRD-PARTY SERVICES
We use third-party platforms.
We are not responsible for third-party outages but will take reasonable steps to maintain continuity of Services.
21. FORCE MAJEURE
We are not liable for delays or failures caused by events beyond reasonable control, including:
- natural disasters
- war or government action
- large-scale platform outages
- systemic technical failures
22. MARKETING & TESTIMONIALS
Testimonials reflect individual experiences only.
No guarantees are made regarding:
- results
- timelines
- comparability of outcomes
Marketing materials are illustrative only.
Where required, consent is obtained for identifiable testimonials.
23. MODIFICATIONS
We may update these Terms.
Material changes will be communicated where required. Continued use constitutes acceptance.
24. GOVERNING LAW
Dutch law applies.
Mandatory consumer protection laws of the consumer’s country of residence apply where required and may override these Terms.
